You are responsible for providing an accurate delivery address. We are not responsible for failed deliveries due to incorrect addresses provided by you. If a delivery attempt is unsuccessful due to your unavailability or inability to receive the order, you may not be entitled to a refund for perishable items.

• THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED THROUGH THE SITE WILL MEET YOUR EXPECTATIONS;
• ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROUND TABLE PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, OR AFFILIATED ENTITIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH:

• Your use of, or inability to use, the Site or our services;
• Any content obtained from the Site;
• Any unauthorized access to or alteration of your transmissions or data;
• The conduct of any third party on or through the Site;
• Any other matter relating to the Site or our services;

EVEN IF ROUND TABLE PIZZA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL ROUND TABLE PIZZA'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO ROUND TABLE PIZZA IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).

Some states do not allow the limitation or exclusion of incidental or consequential damages. If you reside in such a state, the above limitations may not apply to you to the extent prohibited by applicable law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Round Table Pizza and its parent companies, subsidiaries, affiliates, partners, officers, directors, employees, agents, contractors, licensors, service providers, subcontractors, and successors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms of Service;
• Your use of the Site or our services;
• Your violation of any third party's rights, including but not limited to intellectual property rights, privacy rights, or contractual rights;
• Your violation of any applicable law, regulation, or ordinance;

14. Dispute Resolution and Arbitration

14.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you and Round Table Pizza agree to use good faith efforts to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services ("Dispute") informally. You must first contact us at [email protected] and describe the nature of your Dispute and the relief you are seeking. We will attempt to resolve the Dispute within thirty (30) days of receipt of your notice. If the Dispute is not resolved within that period, either party may proceed to binding arbitration as set forth below.

14.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Except as provided below, you and Round Table Pizza agree that any Dispute shall be finally resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in the English language and shall take place in the United States. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

The arbitrator shall have the authority to award any remedy that would otherwise be available in a court of law, but shall not have the authority to award punitive damages unless expressly authorized by applicable statute. The costs of arbitration, including arbitrator fees, shall be allocated in accordance with the AAA's Consumer Arbitration Rules.

14.3 Class Action Waiver

YOU AND ROUND TABLE PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and Round Table Pizza agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

14.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights. You also have the right to bring an individual action in small claims court if the Dispute qualifies under that court's jurisdictional requirements.

15. Term and Termination

These Terms shall remain in full force and effect for as long as you use or access the Site or our services. We reserve the right, in our sole discretion, to suspend or terminate your access to the Site or services, with or without notice and without liability to you, for any reason, including but not limited to:

Round Table Pizza shall not be liable for any delay or failure to perform any obligation under these Terms where such delay or failure results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, civil disturbances, labor disputes, supply chain disruptions, governmental actions, power outages, internet service disruptions, or any other event beyond our reasonable control ("Force Majeure Event"). We will make reasonable efforts to notify you of a Force Majeure Event and to minimize disruption to our services.
